In a disturbing incident that has sent shock waves across Chipinge, Nyasha Brendon Jani (20) has appeared before the Chipinge magistrates’ Court facing Culpable charges.
According to the National Prosecuting Authority of Zimbabwe, on the 13th of November 2023 at around 1630 hours and along Eastern Border Road, Chipinge theĀ accused person while driving a white Toyota Corolla Alex with five passengers on board, lost control of the motor vehicle which swerved to the left side of the road.
He drove for a distance of approximately 54 metres with the left wheel off the road. He tried to drive the vehicle back onto the and swerved off to the right side. Three passengers died on the spot whilst two passengers were ferried to Chipinge District Hospital where he was transferred to Mutare General Hospital.
Particulars of negligence:
a) Travelling at a speed which was excessive in the circumstances
b) Falling to act reasonably when the accident seemed imminent
c) Falling to keep vehicle under proper controlĀ
The accused person pleaded guilty and was sentenced to 18 months imprisonment of which 9 months were suspended for 5 years. The remaining 9 months were suspended on condition that he performs 315 hours of community service.
